These terms cover your use of the GearGraph iPhone app, published by GR Digital Media LLC. Using the app means you accept them.
GearGraph is licensed to you, not sold. Your license to use the app is the one Apple grants: the Licensed Application End User License Agreement, which you accept when you download it, along with Apple's App Store Terms of Service. Those cover the license itself — what you may install it on, and what you may not do with it.
These terms cover everything else: your data, your exports, the VIN lookup, and the limits below. Where Apple's agreement and these terms genuinely conflict about the license, Apple's wins.
GearGraph is free to use for your first 10 logged events. Beyond that, a one-time in-app purchase unlocks unlimited logging. That purchase is permanent for your Apple Account and is not a subscription.
Anything you have already logged stays readable, editable and exportable whether or not you ever buy anything.
All purchases are processed by Apple. We cannot issue refunds ourselves — refund requests go to Apple through reportaproblem.apple.com. If a purchase is refunded, the unlock ends.
You own everything you enter. Because GearGraph has no servers and we hold no copy of your records, we cannot recover your data for you if you lose it. Keeping backups is your responsibility: leaving iCloud enabled, keeping a device backup, and exporting a PDF or CSV of anything you would hate to lose.
You are responsible for what you enter being accurate. GearGraph reports what you tell it.
The optional VIN lookup returns data from a third-party United States government database. We do not control that service, do not guarantee it will be available, and do not warrant that what it returns is accurate or complete. Treat it as a convenience, and check anything that matters.
GearGraph records and summarizes what you enter. It does not tell you whether a vehicle is safe, roadworthy, or worth keeping, and its figures are not financial, legal or mechanical advice. Decisions about your vehicle remain yours, and are properly made with a qualified mechanic.
Reports exported from GearGraph reflect what you entered and nothing more. They are not a certified or independently verified vehicle history, and must not be presented as one. Every page of the PDF says so on its face, so that whoever receives it knows what they are reading — do not remove or obscure that line. If you share an export with a buyer, you are responsible for it being truthful.
GearGraph is provided "as is", without warranties of any kind, express or implied, to the fullest extent the law allows. To the fullest extent permitted by law, GR Digital Media LLC is not liable for any indirect, incidental or consequential damages, or for lost data, lost profits, or vehicle repair costs, arising from your use of the app. Our total liability is limited to what you actually paid for GearGraph.
Not every jurisdiction allows these exclusions, and New Jersey limits some of them. If you live in New Jersey, the disclaimers and liability limits above apply to you only as far as New Jersey law allows, and nothing in these terms gives up a right you have under New Jersey law that cannot be given up. If you live somewhere else, the same goes for the law where you are.
These terms may be updated; the current version always lives at this address with its date at the top. Continuing to use the app after a change means accepting it.
You need to be old enough to enter a contract where you live, or to have a parent or guardian agree to these terms on your behalf. GearGraph is not directed at children.
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules. Any dispute arising out of them belongs in the state or federal courts sitting in New Jersey, and we each agree those courts may hear it. If the consumer-protection law where you live gives you the right to sue closer to home, that right is yours and this paragraph does not take it away.
If any part of these terms turns out to be unenforceable, the rest still stands and the unenforceable part is narrowed only as far as it has to be.
These terms, together with Apple's agreements above, are the whole agreement between us about GearGraph.
Not enforcing something once does not mean giving it up.
You may not transfer these terms to someone else. We may transfer them if the app changes hands — in a sale of the business, for instance — and your rights come with it.
You can stop using GearGraph at any time by deleting it; your records are yours, and exporting them first is worth doing. These terms stop applying when you do, except the parts that by their nature outlast it: the disclaimers, the limits on liability, and governing law.
